DEUTSCHE LUFTHANSA: Dec. 12 Hearing Set for $85M Suit Settlement
The U.S. District Court for the Eastern District of New York will hold a fairness hearing on Dec. 12, 2008, at 11:30 a.m. to consider final approval of the proposed $85,000,000 settlement by Deutsche Lufthansa AG, Lufthansa Cargo AG, and Swiss International Air Lines Ltd. (collectively Lufthansa) in the matter, "In re Air Cargo Shipping Services Antitrust Litigation, Case No. 1:06-md-01775-CBA-VVP."
Any objection or request for exclusion to and from the settlement must be made by Nov. 12, 2008. Deadline for the submission of a claim form is on Feb. 12, 2009.
Case Background
Initially, several purported purported class action suits were filed in the U.S. against certain foreign and domestic air carriers over allegations that they conspired to fix the prices of airfreight cargo shipping services in violation of U.S. antitrust laws.
As a result of this alleged conduct, the plaintiffs contend that they and other members of the class paid more for airfreight cargo shipping services than they would have paid in the absence of this alleged conduct.
On June 20, 2006, the cases were later consolidated in the U.S. District Court for the Eastern District of New York as "In re Air Cargo Shipping Services Antitrust Litigation, 06-MD-1775."
The suit defines members of the class as anyone who purchased or availed of air cargo shipping services from any air cargo carrier, for shipments within, to, or from either the U.S. or Canada. The class period is from Jan. 1, 2000, to Sept. 11, 2006.
To resolve the claims against Lufthansa concerning airfreight cargo shipping services within, to, or from the U.S., it has agreed to pay $85 million for valid class member claims and to cooperate in the prosecution of claims against the remaining defendants who are not part of the U.S. settlement.
